Original web pages
created by an SUS University for a PALMM project should carry
a copyright statement at the bottom of the page:

Copyright Guidelines -- Public Domain
For retrospective digitization, if the
source materials are in the public domain, copyright cannot be claimed in the
digital reproductions, and no
restrictions on use are enforceable.
Do not put a statement of copyright in the bibliographic
record or in the MXF. However, you may put a version statement
in the MXF Version Statement field. Electronic version
created [date], State University System of Florida.
Copyright Guidelines -- Materials Under Copyright
For retrospective digitization,
if the source materials are under copyright, permission from the rightsholder
must be
obtained to digitize the materials and make them available
on the web. Copyright remains with the original rightsholder
unless it is assigned or otherwise transferred to the individual
University, which in general, the rightsholder will not do.
The copyright holder may give an individual University a
license to digitize the material for the web and to place
appropriate conditions in the license agreement. Restrictions
may be placed upon use of these materials so long as these
do not negate Fair Use. The University should obtain the
written permission of the copyright holder, including an
agreed upon statement of copyright and permissions for display
with the digitized materials.
Treatment of copyrighted materials in PALMM projects
If
the source document is under copyright and digitized with permission:
Print out the statement of copyright and permissions that was negotiated with
the rightsholder. Digitize this, and include it as the first page of the digitized
document.
In the Entity level of the MXF, fill in hte Copyright field with a note indicating
the material was digitized with permission of the copyright holder.
Include a Div for the digitized statement, using the value "permission" for
the Type of Part.
Edit the bibliographic record: include a 540 note as specified in the CAGER
Guidelines with the text of the specific copyright permission statement.
